1. Acceptance of Terms
Your use of PERFIT’s website, products, or services constitutes acceptance of these Terms. If you disagree, do not use the site or purchase products.
2. Eligibility
You must be at least 18 years old or have legal guardian consent to purchase products.
3. Custom Orders
Design Responsibility: You are responsible for ensuring custom designs (e.g., uploaded graphics, text) comply with laws and do not infringe third-party rights.
Approval Process: Custom orders require final approval via email before production. Changes after approval may incur fees.
Irreversible Production: Once production begins, custom paddles cannot be canceled or refunded unless defective.
4. Payment & Pricing
Currency: All prices are in USD. International orders may be subject to exchange rates or fees.
Payment Security: We use encrypted payment gateways. PERFIT does not store credit card details.
Custom Order Deposits: Non-refundable 50% deposit required to start production.
5. Shipping & Delivery
Lead Times: Custom paddles ship within 14 business days unless otherwise noted. Delays (e.g., material shortages) will be communicated via email.
International Orders: Customers are responsible for customs fees, taxes, or import duties.
Risk of Loss: Products become your responsibility once delivered to the shipping carrier.
6. Returns & Refunds
Standard Products: Unused, unopened items may be returned within 30 days for a full refund (minus shipping internationally).
Custom Products: Non-defective custom paddles are final sale. Defective items are covered under our Warranty Policy.
First Swing Guarantee: If unsatisfied with performance, contact us within 30 days for a redesign or store credit.
7. Intellectual Property
Ownership: All website content, logos, and product designs are owned by PERFIT. Unauthorized use is prohibited.
Custom Designs: By uploading graphics, you grant PERFIT a non-exclusive license to reproduce them for production. You certify ownership or legal rights to all submitted content.
8. Limitation of Liability
PERFIT is not liable for:
Incidental, consequential, or punitive damages arising from product use.
Errors in website content, pricing, or product specifications.
Third-party actions (e.g., shipping delays, customs seizures).
9. Dispute Resolution
Governing Law: Disputes are governed by California law.
Arbitration: Claims must be resolved through binding arbitration in San Diego, CA. Class actions are waived.
10. Warranty Claims
All warranty claims are subject to the terms outlined in our Warranty Policy.
11. Website Use
Prohibited Conduct: No hacking, scraping, or unauthorized use of site content.
Accuracy: We strive for accuracy but do not guarantee error-free descriptions, pricing, or availability.
12. Third-Party Sales
Purchases from unauthorized retailers (e.g., Amazon, eBay) are not covered by PERFIT warranties or return policies.
13. Amendments
PERFIT reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance.
